Jones Day's representation of Union Pacific Railroad Company recognized at 2026 GCR Awards

Voters selected In re: Rail Freight Fuel Surcharge Antitrust Litigation, in which Jones Day represents Union Pacific Railroad Company, as the winner of the Litigation of the Year – Cartel Defense category at Global Competition Review's 2026 GCR Awards. This annual awards ceremony recognizes the world's leading antitrust matters and lawyers.

 

The Rail Freight Fuel Surcharge litigation spanned nearly two decades and encompassed over one hundred lawsuits coordinated in multi-district proceedings in the U.S. District Court for the District of Columbia. The plaintiffs, companies that ship freight by railroad, alleged that the nation's four major rail carriers conspired to impose aggressive fuel surcharges on their customers from 2003 to 2008. Jones Day successfully represented Union Pacific, obtaining summary judgment on June 27, 2025.
