The Nielsen Company obtains preliminary injunction

Jones Day obtained a preliminary injunction for The Nielsen Company (US), LLC, NeuroFocus, Inc., and TNC (US) Holdings, Inc. (collectively "The Nielsen Company") against the former chief executive officer of a Nielsen entity. Jones Day pursued the injunction on behalf of The Nielsen Company and its neuroscience testing research unit to enforce a non-competition agreement against former employees who founded a competing start-up company named MoodCast. Jones Day persuaded the California Superior Court to enjoin the former chief executive officer from engaging in business of the same type and character and competitive with the affected Nielsen business as of the time the parties entered into the non-competition agreement. The court's order further recognized that the defendant would necessarily be unable to solicit clients and employees to any competing business in which he was involved. The technology in the case involves commercial applications for assessing emotions and transforming music using neuroscience, signal processing and machine learning.
