American Society of Clinical Oncology resolves privacy claims in multidefendant lawsuit related to Facebook cookies

Jones Day represented the American Society of Clinical Oncology ("ASCO") in putative class action alleging that ASCO improperly disclosed plaintiffs’ personal information, including browsing history, to Facebook through the use of Facebook code on ASCO’s website. Plaintiffs brought claims under the Federal Wiretap Act and California wiretapping statutes as well as common law privacy claims. The court dismissed the case, and in doing so rejected plaintiffs’ claim that ASCO’s inclusion of Facebook code on its website created a basis for personal jurisdiction in the Northern District of California.
