Penn State wins Third Circuit decision affirming dismissal of suit brought by former student-athlete relating to alleged hazing by teammates

Jones Day prevailed at the U.S. Court of Appeals for the Third Circuit on behalf of the client, The Pennsylvania State University ("Penn State"), in a Title IX case in which a former defensive back on the Penn State football team claimed he was subjected to sexual abuse in the football locker room as part of a hazing rite of passage. The Third Circuit affirmed a federal district court’s granting of a motion to dismiss that the firm had filed on behalf of Penn State and a former coach. In addition to claiming Title IX violations, the former player had asserted claims of negligence, negligence per se and negligent infliction of emotional distress, each of which also were dismissed.
