U.S. Steel prevails before Sixth Circuit

Jones Day client United States Steel Corporation ("U.S. Steel") prevailed before the Sixth Circuit Court of Appeals. U. S. Steel's long-time construction and demolition contractor, Allied Erecting & Dismantling, first filed its complaint in 2012, seeking over $40 million in damages for alleged contract breaches related to its work at U. S. Steel plants. The parties went through a three-week jury trial, where U. S. Steel prevailed on virtually all of Allied's claims, a successful $10 million counterclaim, two previous appeals, and two remands. The Sixth Circuit affirmed the lower court's pretrial rulings, including favorable Daubert and motions in limine rulings, and ended over ten years of litigation. The Sixth Circuit also denied Allied's petition for rehearing en banc.
