ConsumerInfo.com successfully defends putative class action lawsuits related to alleged violations of California consumer fraud statutes

Jones Day client ConsumerInfo.com (CIC), an Experian Information Solutions affiliate, successfully defended multiple putative class action lawsuits filed by thousands of consumers alleging that CIC's representations on its FreeCreditScore.com website violated California consumer fraud statutes. The district court ordered the cases to arbitration, rejecting plaintiffs' challenges to the validity of the arbitration provisions pursuant to which consumers purchase products from CIC's website. The plaintiffs made a consolidated appeal to the Ninth Circuit, which dismissed the appeal, finding that federal arbitration law bars plaintiffs from appealing an order requiring them to arbitrate their disputes.
