Allegiant Air secures preliminary injunction barring pilot strike

Jones Day secured a preliminary injunction on behalf of Allegiant Air, LLC, barring the union that represents its pilots, the International Brotherhood of Teamsters, Airline Division and its Local No. 2118, from striking over new rules adopted by the carrier as part of its General Operations Manual. Shortly before the Memorial Day holiday weekend, the union gave Allegiant roughly 24 hours' notice of its intent to strike over rules that require pilots to return calls from the company regarding operational issues in a timely manner. Jones Day sought a temporary restraining order and preliminary injunction on behalf of Allegiant on the ground that the threatened strike would violate the Railway Labor Act. Following a two-day expedited evidentiary hearing before the U.S. District Court for the District of Nevada, the court granted Allegiant's request for injunctive relief just minutes before the strike was set to begin. The court further ordered the union to immediately notify its members of the court's ruling and direct them not to strike, averting an illegal job action that would have immediately and indefinitely grounded Allegiant's aircraft and stranded thousands of passengers right before a major holiday weekend.
