Xilinx resolves patent infringement dispute with Intellectual Ventures related to power controls

Jones Day represented California-based Xilinx, Inc. in its multi-district patent litigation battle against the world's largest patent aggregator Intellectual Ventures ("IV"). The conflict arose in 2010 and at one point involved sixteen patents in three federal district court actions in California and Delaware. The consolidated Delaware actions were scheduled to proceed to trial on May 12, 2014, where IV's case for damages rested on the testimony of its damages expert. Using a novel argument, Jones Day successfully obtained an order excluding the testimony of IV's damages expert at trial and on April 17, 2014, the Court issued a further order denying IV's request to supplement its expert report on damages, effectively gutting IV's case for trial. Then on April 21, 2014, the Court issued an additional order granting Xilinx's motion for summary judgment of no willful infringement. Shortly following these orders, the parties settled all their disputes resulting in the dismissal of the cases on May 2, 2014.
