Interactive Brokers defeats aiding-and-abetting securities claim at Ohio Supreme Court

Jones Day successfully represented Fortune 500 trading platform Interactive Brokers LLC ("Interactive Brokers") before the Ohio Supreme Court, obtaining reversal and dismissal of a $25 million securities case. Following a trend of plaintiffs in various areas, these plaintiffs sued Interactive Brokers for allegedly aiding and abetting the securities violations of others. Interactive Brokers was liable, the plaintiffs argued, for permitting the alleged wrongdoers on its platform and failing to investigate "red flags."
After the intermediate appellate court agreed with the plaintiffs, Jones Day was hired to take the case to the Ohio Supreme Court. Jones Day successfully obtained discretionary review and reversal. The Ohio Supreme Court's opinion provides important limits on secondary and aiding-and-abetting liability under the Ohio Securities Act and otherwise.
