Kiewit successfully opposes LNG developer's request for temporary restraining order (TRO) preventing testimony of Kiewit witness for alleged violation of confidentiality obligations in EPC agreement

Jones Day obtained a favorable, non-monetary settlement after submitting detailed papers in opposition to the developer of a multi-billion dollar LNG facility's request for a TRO and expedited discovery that, among other things, required dismissal of the lawsuit and expressly stated Kiewit admitted no wrongdoing. The developer had argued that Kiewit had violated its confidentiality obligations in the EPC Agreement by disclosing documents and providing a witness statement in an ICC arbitration initiated by one of the developer's customers. The stipulated court order resolving the matter permitted the testimony of the Kiewit witness to proceed.
