Jane Story has counseled clients for more than 15 years in state and federal environmental health and safety issues in the context of litigation, compliance counseling, and business transactions.
Jane regularly defends clients against federal and state enforcement actions for alleged violations of environmental law brought by the U.S. Department of Justice (DOJ), U.S. Environmental Protection Agency (EPA), and various state environmental agencies. She has also defended clients against allegations of environmental crimes made by the Pennsylvania Office of Attorney General.
Her active litigation practice includes representing clients in Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) cases, addressing issues such as the scope of arranger liability and the intricacies of cost recovery versus contribution claims. In addition, Jane has litigated claims involving environmental toxic torts and indemnification claims related to transfer of environmental liabilities in business transactions.
Jane counsels clients on a diverse range of environmental matters, including crisis management in the wake of environmental industrial accidents, shipment of hazardous materials, and management of removal and remedial actions at Superfund sites.
She also analyzes and manages risks associated with environmental liabilities in business and real estate transactions, assisting clients with environmental due diligence and developing options for management of material liabilities.
Jane is a former chair of the Environment and Energy Law Section of the Allegheny County Bar Association and a member of the Section of Environment, Energy and Resources of the American Bar Association and the Environmental and Energy Law Section of the Pennsylvania Bar Association.
