Al Rota has spent nearly 25 years representing financial institutions and major corporations in bet-the-company litigation, industry-changing regulatory developments, and critical enforcement matters that threaten to fundamentally alter their businesses. He is a member of Jones Day's Private Credit analysis team, focused on advising clients concerning key issues arising in the industry.
Al has represented clients in structured products litigation, securities and consumer finance class actions, mass arbitrations, False Claims Act (FCA) cases, SEC and DOJ and state Attorney General investigations, and CFPB (Consumer Financial Protection Bureau) and prudential regulator examinations, investigations, and enforcement actions. He also counsels investment advisors regarding risks and legal developments relating to investments in products and companies involved in consumer financial services. Al's commercial litigation experience includes defending class actions, prosecuting and defending commercial breach of contact claims, and claims against state and governmental agencies.
Al's recent representations include defending financial institutions against cutting-edge claims challenging industry practices and established financial products. He has defended financial institutions in class actions brought against a student loan securitization trustee and special servicer concerning allegedly unfair and deceptive practices; class actions and other significant cases brought against a RMBS (residential mortgage-backed securities) trustee; mass arbitrations and class actions against financial institutions concerning overdraft fees; examinations concerning allegedly unfair and deceptive mortgage servicing and checking account practices; CFPB investigations pertaining to payment processing, short-term lending, and unfair and deceptive practices; and various OCC (Office of the Comptroller of the Currency), FDIC (Federal Deposit Insurance Corporation), CFPB, and attorney general investigations.
Al is a member of the Dallas Regional Chamber's Leadership Dallas Class of 2017. He regularly writes and speaks on issues related to consumer financial products and securitizations.
