Google secures Federal Circuit affirmance of patent ineligibility in case involving YouTube products
Client(s) Google LLC
Jones Day won a total victory for Google LLC ("Google") at the Federal Circuit, which affirmed the dismissal of a complaint brought by plaintiff US Patent No. 7,679,637 LLC in the Western District of Washington. The plaintiff alleged that Google's YouTube products infringed claims generally relating to the asynchronous viewing of web conferences. At the district court, Jones Day successfully moved to dismiss the complaint, establishing that the asserted claims are invalid under 35 U.S.C. § 101 as directed to patent-ineligible subject matter—the abstract idea of playing back recorded content. The plaintiff appealed, raising substantive challenges to the district court's patent-ineligibility analysis. The Federal Circuit issued a precedential decision affirming the district court in full.
