Air Evac's district court dismissal of putative class action affirmed in Eighth Circuit

Jones Day represents Global Medical Response, Inc. subsidiary Air Evac EMS, Inc. ("Air Evac") against claims filed on behalf of a putative class of consumers in Arkansas alleging Air Evac charges improper fees for its services. Jones Day filed a motion to dismiss all of plaintiff's claims on the basis that they were preempted by the federal Airline Deregulation Act of 1978 ("ADA"). The district court granted the motion in full and dismissed the case. After extensive briefing and following oral argument, the Eighth Circuit affirmed the dismissal of all of Plaintiff's claims based on preemption under the ADA.
