Stone & Webster and Stone & Webster Canada settle litigation with owner of polymer chemical plant located in Ohio

Client(s) Stone & Webster, Inc. and Stone & Webster Canada, L.P.

Jones Day successfully represented Stone & Webster, Inc. and Stone & Webster Canada, L.P., two companies within The Shaw Group, as design professionals in connection with unpaid professional fees and expenses and an owner's claim for defective work performed on the design and construction of a polymer chemical plant. The owner asserted a multimillion dollar claim against our client for breach of contract and professional negligence. There was also a dispute relating to the disputed terms of the engineering and procurement contract. The parties agreed to binding arbitration. After a 3 day arbitration on the applicable contract, the panel adopted our client's interpretation of the terms of the contract. Following that ruling, the parties were eventually able to reach a settlement in which the claims made by our client and against our client were settled favorably.
