Donte Parrish wins U.S. Supreme Court victory on notice of appeal issue

Jones Day represented Donte Parrish in the U.S. Supreme Court in a case presenting a question about notices of appeal that is particularly important to pro se incarcerated litigants. Mr. Parrish filed a notice of appeal before the district court granted his motion to reopen the appeal period. The United States agreed that his notice was sufficient. Nevertheless, the Fourth Circuit held that he had lost his right to appeal by failing to file a second notice of appeal within the 14-day reopening period. Jones Day helped Mr. Parrish convince the Supreme Court to grant certiorari and briefed and argued the case on the merits. The Supreme Court ruled 8-1 in favor of Mr. Parrish’s position, vindicating his right to pursue an appeal and ensuring that other pro se litigants won’t be penalized for filing a notice of appeal too early.
