Pharmaceutical client prevails in ICC arbitration arising from royalty dispute

Jones Day served as lead counsel for a pharmaceutical client and the licensor in a cross-border arbitration. The parties to a licensing agreement disputed the length of the royalty term in the United States for a successful pharmaceutical product. When the licensee refused to pay our client royalties after a certain date, an arbitration ensued before the International Chamber of Commerce (ICC). Following a six-day hearing in Europe, the three-member Tribunal accepted our client's position on the length of the royalty term and unanimously awarded our client all of the royalties it was seeking, plus costs and attorneys' fees.
