Milliken defeats Kolay's motion for preliminary injunction in "Free Lay" flooring case

Jones Day client Milliken & Company defeated a motion for preliminary injunction filed by competitor Kolay Flooring International, LLC, who alleged trademark infringement of the term "Free Lay" for flooring laid without permanent adhesive. The court denied Kolay's motion for preliminary injunction before the hearing could take place on the basis of arguments that Kolay presented no evidence of irreparable harm and delayed in seeking injunctive relief.
