Google wins patent trial in WDTX against WSOU Investments and Federal Circuit affirms

Jones Day obtained a trial victory on behalf of Google LLC ("Google") in a patent litigation where plaintiff WSOU Investments LLC ("WSOU") sought more than $100 million in damages based on allegations that Google Maps infringed patent claims generally relating to the delivery of location-based services.

After WSOU rested its case at trial, Google moved for Motion for Judgment as a Matter of Law (JMOL) by presenting several reasons why WSOU failed to prove infringement. Crediting Google's argument that the claimed method steps must be performed in a particular sequence, the district court held that WSOU failed to present any evidence that Google Maps' accused features followed the required sequence.

On appeal, WSOU raised numerous procedural and substantive challenges. After oral argument, the Federal Circuit summarily affirmed the district court's judgment of no infringement as a matter of law in 2026.
