U.S. Steel prevails before Second Circuit

On behalf of client United States Steel Corporation ("U.S. Steel"), Jones Day prevailed before the Second Circuit Court of Appeals. The court affirmed the complete dismissal with prejudice of an amended complaint brought by the commercial tenant of an industrial complex, who complained of demurrage fees assessed by a rail carrier. Seeking over seven figures in damages, the plaintiff brought several causes of action, including breach of contract, fraudulent inducement, and unjust enrichment. The Second Circuit unanimously agreed with the lower court that the plaintiff's complaint failed to state a valid legal claim and that any further amendments to the complaint would be futile.
