Hesh Parlikad represents companies and financial institutions in all phases of litigation, including trial, arbitration, and appellate proceedings. His practice focuses on disputes involving complex financial products and securities, and he has litigated and tried novel disputes arising out of the Lehman bankruptcy concerning derivatives governed by International Swaps and Derivatives Association (ISDA) documentation. He has also represented financial institutions in prelitigation and litigation matters concerning securitizations and structured financial products. Hesh also has an active ESG (environmental, social, and governance) practice and routinely represents clients in disputes concerning traditional and renewable energy and carbon market transactions, including power purchase agreements, virtual power purchase agreements, and proxy revenue swaps. He has also litigated energy-finance matters concerning force majeure and other disruptions in the context of the increased power demand driven by the data center build-out.
In addition, Hesh has in-depth experience litigating cross-border issues and defending foreign companies in U.S. courts. He advised Tech Mahindra on U.S. securities laws issues involved in its successful acquisition of India-based and NYSE-listed Satyam Computer Services in 2009, and then represented Tech Mahindra in securities and investor cases in the United States and England. Through this, Hesh helped Tech Mahindra successfully resolve much of the worldwide investor claims faced by Satyam.
Hesh chairs the Inclusion and Advancement Committee in Jones Day's New York Office. He also chairs the Endorsements Committee of the South Asian Bar Association of North America.
