With a practice focused on products liability and complex litigation in highly regulated industries, Anderson Bailey has developed substantial experience in sophisticated, high-profile matters. Recent cases include obtaining dismissal at the pleading stage of two statewide public nuisance cases seeking medical monitoring and abatement of environmental lead; the successful defense of coordinated litigation over alleged childhood lead exposure, in which the defendants prevailed at summary judgment in a series of decisions — including two precedential Seventh Circuit opinions — that ended more than a decade of litigation by approximately 150 individual claimants; a precedential appellate decision directing dismissal of public nuisance cases over alleged toxic exposure; a successful bench trial that resulted in statewide injunctive relief against state regulators in the health care context; and several ongoing defenses of class action and alleged toxic exposure cases.
On case teams, Anderson typically helps lead case strategy and coordinates motion practice and briefing efforts. He has successfully briefed and argued dispositive motions, upheld favorable judgments on appeal, and obtained reversals of unfavorable judgments.
Anderson also has had notable pro bono achievements. He successfully led a novel due process challenge to Pennsylvania's procedures for post-conviction DNA testing; successfully argued an en banc appeal to obtain a new trial for a defendant who spent four decades in prison; and negotiated a settlement valued at $2 million for a client alleging abuse by prison staff.
