UPMC resolves two antitrust lawsuits

Jones Day client the University of Pittsburgh Medical Center (UPMC) resolved two antitrust lawsuits after it moved to enforce a 2012 global settlement agreement that had been negotiated by Pennsylvania Governor Tom Corbett. The first lawsuit was filed by West Penn Allegheny Health System (WPAHS) against UPMC in 2009, and alleged violations of the Sherman Act. The second lawsuit was an affirmative antitrust lawsuit filed by UPMC against WPAHS and Blue Cross Blue Shield medical insurer Highmark Inc. The parties were able to settle the lawsuits pursuant to the global settlement agreement, which was designed to resolve a series of disputes that arose following Highmark's decision to purchase WPAHS, UPMC's primary competitor.
