Rabbi and Chabad secure settlement for nearly $1 million in lawsuit correcting antisemitic actions by homeowners' association

Jones Day successfully represented Rabbi Naftaly Hertzel, his wife, Henya Hertzel, and their Chabad secure policy changes and nearly $1 million to remedy years of antisemitic harassment by a South Florida homeowners' association. In partnership with the First Liberty Institute, Jones Day sued the homeowners' association under the Fair Housing Act and 42 U.S.C. 1982. The Firm argued that the association's policies facially discriminated on the basis of religion by preventing in-home worship and that the association had subjected the Hertzels to years of discriminatory treatment and harassment because of their faith.
Jones Day hammered out the settlement after persuading a federal judge to deny the association's motion to dismiss the lawsuit and uncovering critical documents in discovery to support the Hertzels' claims.
