Orlando Health contests unfair labor practice charges

Jones Day advised Orlando Health, Inc., a health care system with more than 13,000 employees in Central Florida, in connection with a campaign by the National Nurses Organizing Committee ("NNOC"), an affiliate of National Nurses United ("NNU"), and the Service Employees International Union ("SEIU") to unionize nurses and other employees across eight of Orlando Health's hospitals. Jones Day represented Orlando Health in contesting ten unfair labor practice charges, including 36 allegations of unlawful conduct at five of its hospitals. Jones Day obtained full dismissal of 22 of the allegations against Orlando Health and challenged the remaining allegations, primarily related to employee off-duty access rights and discipline, at a six-day National Labor Relations Board hearing in April and May 2014. More than 34 witnesses testified at the hearing and Orlando Health produced nearly 4,000 pages of documents pursuant to an NLRB subpoena. The parties reached a confidential non-Board settlement that the Administrative Law Judge approved on October 15, 2014.
