Amniox Medical obtains consent injunction enforcing restrictive covenants

In proceedings under the State of Georgia’s relatively new Restrictive Covenants Act, Jones Day secured an injunction on behalf of Amniox Medical, Inc. ("Amniox") enforcing a covenant not to compete between Amniox and one of its former sales agents. The dispute concerned amniotic tissue products developed by Amniox for surgical dressing, wound care and reconstructive purposes. Amniox sought to prevent its former agent from selling competing products in violation of restrictive covenants in the parties’ sales agent agreement. After Amniox filed a Complaint and Motion for Temporary Restraining Order in the Superior Court of Cobb County, Georgia, the parties agreed to an consent injunction, which the court then entered.
