ESO Capital successfully resolves €50+ million multi-jurisdictional project refinancing dispute

Clients European Special Opportunities Master Fund II Limited

Jones Day successfully represented ESO Capital Luxembourg Holdings II S.A.R.L ("ESO") in its claim for €50+ million in relation to a dispute arising out of its refinancing of a property construction and development project in the French West Indies, culminating in a successful settlement in the summer of 2011. This was a multi-jurisdictional dispute involving three sets of arbitration proceedings in the London Court of International Arbitration, together with multiple sets of proceedings in the Cayman Islands (including successfully defending injunction proceedings seeking to prevent a winding up petition being issued by ESO on the primary basis that there was a genuine and substantial dispute between the parties) and Luxembourg.
