Indigent client feared she would lose her home to a bail bonding company

Jones Day Irvine recently represented an indigent client who feared that she would lose her home to a bail bonding company which took a deed of trust on the home to secure a bond issued to allow her son to be released from jail. The client desperately needs to obtain a modification of her home mortgage, but was unable to seek a modification because of the existence of the junior deed of trust held by the bonding company. Even though her son had plead guilty to a minor offense and been released and the bail bond had been exonerated by the court, the bonding company continued to invoice additional "fees" and refused to reconvey the deed of trust. Just after Jones Day agreed to represent this client, the bonding company sued her. Our attorneys promptly convinced the plaintiff bonding company to dismiss the entire lawsuit with prejudice, to reconvey the deed of trust and to cease sending monthly invoices to the client.
