ON Semiconductor files patent infringement suit following Samsung's declaratory judgment action

Client(s) ON Semiconductor Corp.

Jones Day represented ON Semiconductor Corp. as the plaintiff in a patent infringement action, also involving one Samsung counterclaim patent. Samsung filed a declaratory judgment during licensing negotiations in D. Del; On Semiconductor then filed an action involving another On Semiconductor patent, in addition to the three included in the DJ action in E.D. Tex. Motion practice resulted in the E.D. Tex. case being transferred to D. Del. on "first to file" basis. In D. Del., the transferred and original cases were consolidated and discovery commenced. A motion for judgment based on lack of DJ jurisdiction was denied by D. Del. court (4/3/08). Discovery is continuing.
