National City Bank prevails in case involving employees' use of computers to conduct work for competitors

Client(s) National City Corporation and National City Bank

Jones Day successfully defended National City Corporation and National City Bank (d/b/a National City Mortgage and National City Mortgage Company) against a Motion for a Preliminary Injunction and succeeded in its request for an inspection and imaging of computers and servers. National City had cause to believe its employees were still affiliated with their former employer. The employees left behind computers that appeared to have been used to conduct work for National City's competitors. At the July 2008 evidentiary hearing, the district court granted National City's request to inspect the computers and hard drives and set aside Plaintiff's request for a Preliminary Injunction.
