Munhwa Broadcasting awarded $850,000 after willful trademark infringement case

Client(s) Munhwa Broadcasting Corporation (MBC)

Jones Day was retained by Munhwa Broadcasting Corporation (MBC) and obtained a preliminary injunction for the largest Korean broadcast network on a world-famous but unregistered mark for a television series against a Korean-American noodle manufacturer. After discovery and following the Court's removal of the reference from bankruptcy, the Court found our client had a high probability of establishing willful infringement and approved a consent decree resulting in an $850,000 award to our client for defendant's sale of less than $5,000 of the infringing product.
