Margaret Toohey represents clients on both the plaintiff and defense sides in high-stakes, cross-border litigation and arbitration, including multibillion-dollar class actions and "bet the company" disputes.
A seasoned trial advocate, Margaret has taken more than a dozen matters to final merits hearings. Her arbitration experience includes AAA, CPR, ICAC, ICC, ICDR, ICSID, and LCIA proceedings, applying EU, Brazilian, Kazakh, Italian, Russian, Spanish, and Swiss substantive laws (among others). In the litigation arena, she recently oversaw Section 1782 discovery taken across five U.S. circuits for use in the largest group litigation in English legal history.
Margaret focuses on disputes in the mining, manufacturing, and construction sectors. She has litigated and arbitrated multiple cases involving environmental contamination, design and manufacturing defects, and alleged unfair competition practices. She also handles force majeure and business interruption claims, including claims arising from plant accidents, supply chain disruptions, and international sanctions.
In addition, Margaret represents health care clients in global disputes related to product development, commercialization, and distribution. Margaret has represented leading hospital systems, retail pharmacies, and biotech, pharmaceutical, and medical device companies in cases involving mRNA vaccines, prescription opioids, and emerging biotherapies.
Beyond her disputes work, Margaret regularly counsels clients navigating global commercial challenges. She also maintains an active pro bono practice, securing asylum for political dissidents.
Margaret serves on the Board of Canalway Partners, the Junior Board of EDWINS Leadership & Restaurant Institute, and is a member of the Cleveland Committee on Foreign Relations.
