Verizon Wireless prevails in putative nationwide FLSA collective action brought by retail store employees

Jones Day represented Verizon Wireless, Inc. in a putative nationwide FLSA collective action which alleged claims for off-the-clock work/unpaid overtime on behalf of current and former employees at Verizon Wireless' 2000-plus retail stores across the country. At an initial hearing with the Court, Jones Day successfully limited initial discovery - over the plaintiff's objections - to the four stores where the plaintiff had worked. The plaintiff had sought burdensome nationwide discovery. After plaintiff's deposition and other initial discovery, plaintiff again sought to expand the scope of discovery. After the Court again ruled in favor of Verizon Wireless on this issue, the plaintiff dropped his class action claims and the case was resolved on an individual basis.
