The trial court dismissed each count of the indictment on its face, stating that the allegations in the indictment did not constitute a violation of the applicable criminal laws and that all the charges were time-barred. The appellate division unanimously affirmed the lower court finding that each count either failed to allege a crime or was outside the statute of limitations.
