Chemical manufacturer wins unanimous victory at Supreme Court of Alabama, securing complete dismissal of tort claims

Jones Day client Daikin America, Inc. won mandamus at the Supreme Court of Alabama, securing a complete dismissal in a tort case involving PFAS. After the trial court had denied Daikin's motion to dismiss, Jones Day asked the Supreme Court to issue a writ of mandamus ordering the trial court to rule in Daikin's favor. Although this remedy is "extraordinary," the Supreme Court unanimously agreed with Jones Day's statute-of-limitations arguments and issued the writ. This ruling required the trial court to dismiss Daikin from the case and set a favorable precedent for Daikin and other chemical manufacturers in future cases.
