Experian prevails on appeal in nationwide class action

Jones Day obtained a significant victory for client Experian Information Solutions, Inc. in a nationwide putative consumer class and individual action alleging a panoply of claims under the Fair Credit Reporting Act ("FCRA") against Experian. In its decision, the Ninth Circuit Court of Appeals affirmed the decision of the District Judge, the Hon. Richard Boulware, granting Experian's motion for summary judgment and dismissal of class claims in its entirety. The case was brought by repeat plaintiffs' lawyer Miles Clark of Knepper & Clark, who has filed dozens of individual and nationwide class actions against Experian. The decision terminates nationwide class action litigation that has been pending against Experian since 2016.
