Investment Corporation of Palm Beach appeals denial of license to conduct slots machine gaming

Jones Day is representing the Investment Corporation of Palm Beach in its appeal of a decision by the Florida Department of Business and Professional Regulation to deny the company a license to conduct slots machine gaming. Prior to making its decision, the agency sought advice from the Florida Attorney General's office, which interpreted the relevant Florida constitutional provisions and statues in a way that nullified Florida's affirmative legislative authorization for the expansion of slot machines, provided local support was shown via local referendum in the affected county. The results of this case will have statewide importance in terms of the constitutional authority of the legislature to enact legislation in this area; the meaning of an earlier constitutional amendment adopted by Florida's electorate to expand the location of gaming in the state; and the authority of local governments and their electorate to allow gaming within their jurisdictions.
