Construction company defends against highway delay claims and pursues recovery in dispute with state transportation agency

Jones Day is representing a construction company in a dispute with a state Department of Transportation ("DOT") over highway construction delays. The DOT sued the construction company asserting, inter alia, that the construction company did not comply with the contract's notice provisions to seek additional compensation and time extensions, and therefore, that the construction company should be denied any such relief. In response, the construction company filed a counterclaim for recovery of compensation for added or changed work resulting from the DOT's conduct and other factors outside of the construction company's control, including the COVID-19 pandemic.
