Jones Day's Product Liability Practice delivered decisive outcomes, drawing on the Firm's trial-ready approach, deep bench, and seamless integration with the appellate team. The Firm secured a series of pivotal rulings for Daikin in nationwide PFAS litigation: an Alabama trial court dismissal of utilities' common-law claims; an Alabama Supreme Court decision rejecting the continuing-tort doctrine and thus time-barring most utility claims; and a federal court's dismissal of an $850 million claim tied to land treated with carpet-industry waste. In Cook County's first bellwether trial among more than 400 ethylene oxide cases, Jones Day’s defense of STERIS's Isomedix resulted in a mistrial after a 21-day proceeding in which post-trial interviews indicated jurors favored the defense 10–1, ultimately leading to a resolution that significantly mitigated exposure in the broader docket. In opioid litigation described as one of the most complex in American history, Jones Day secured multiple wins for Walmart, including dismissal of RICO claims in the District of New Mexico, affirmance of a dismissal with prejudice in Maine, and a Sixth Circuit ruling vacating an MDL "equitable abatement" award, eliminating injunctive relief and a $650 million monetary component.

 

Jones Day's Issues & Appeals Practice continued its long-standing reputation for developing innovative arguments that shape the law in the Supreme Court and appellate courts nationwide and led among firms in Supreme Court arguments over the past two Terms. In a unanimous U.S. Supreme Court decision, Jones Day secured a landmark ruling for Smith & Wesson and the U.S. firearms industry, with the Court holding that the Protection of Lawful Commerce in Arms Act bars attempts by foreign sovereigns to hold U.S. manufacturers liable for cartel violence in Mexico and rejecting efforts to plead around the statute through aiding-and-abetting theories. The Firm also prevailed at the Supreme Court for retailers and R.J. Reynolds in a venue and standing dispute involving FDA marketing denial orders, confirming that retailers are "adversely affected" and may bring challenges in their home circuits when orders bar sales of the products they carry. And in a significant Fifth Circuit victory arising from a long-running energy bankruptcy, Jones Day won reversal of an order that had improperly awarded both property and its value to the estate, restoring control of a billion-dollar company to secured lenders represented by the Firm.
