Jones Day represented a coalition of market participants in a successful challenge to proposed revisions to ISO New England's Financial Assurance Policy that would have eliminated the use of unsecured credit for all market participants that do not serve retail load at government-established rates. FERC agreed with the coalition members that the selective elimination of unsecured credit was unduly discriminatory and preferential and rejected the proposed tariff changes.
