Parse secures Federal Circuit affirmance of PTAB patent obviousness decision involving single cell analysis claims

Jones Day secured a complete appellate victory for Parse Biosciences, Inc. ("Parse") when the Federal Circuit affirmed three Patent Trial and Appeal Board (PTAB) final written decisions holding every claim of three 10x Genomics, Inc. ("10x") patents unpatentable as obvious. The patents cover methods for analyzing nucleic acids from single cells, including molecular tagging used to link sequencing results to originating cells and sampled molecules. Rejecting all four appellate challenges, the court held that substantial evidence supported the Board’s motivation-to-combine findings and that 10x had not preserved one theory raised on appeal. The ruling preserves the invalidation of patents asserted against Parse’s Evercode products, protecting those core products from the damages and injunctive relief 10x sought while reinforcing Parse's ability to compete and innovate in single-cell sequencing.
