Susan Conley successfully challenges City of Pataskala’s decision to deny her permit for nativity scene on city property

At Jones Day’s urging, the City of Pataskala reversed its unconstitutional decision to deny Susan Conley a permit for a nativity scene on city property. The City denied Ms. Conley’s application to include a nativity scene on the town green during her holiday-themed farmers market because of the religious nature of the display. After pre-suit discussions and a demand letter explaining the relevant constitutional law, the City agreed to reverse the decision and abandon its unconstitutional policy. Ms. Conley and future applicants will be permitted to use city property for religious expression as the Constitution requires.
