Dan Loesing represents clients in complex litigation matters at every stage, from responses to complaints to state and federal high court appeals, across a variety of substantive areas, including contractual disputes, shareholder lawsuits, and multidistrict litigation.
Dan's experience defending clients ranges from multibillion dollar multidistrict litigations to single plaintiff lawsuits. Dan has represented fiduciaries in a class action lawsuit under the Employee Retirement Income Security Act (ERISA), a pharmaceutical company in a multidistrict antitrust litigation, and current and former corporate directors in shareholder lawsuits before the Delaware Court of Chancery and Delaware Supreme Court. He also has represented Huntington National Bank in an appeal before the Ohio Supreme Court, in which the Court allowed enforcement of a $77 million personal guaranty. Dan also represented a client in many single-consumer lawsuits under the Fair Credit Reporting Act (FCRA), where, among other things, he prepared, took, and defended depositions.
Dan maintains an active pro bono practice. He has represented clients in a First Amendment free exercise matter, concluding in a consent judgment, and was part of a team that successfully litigated a client's asylum claim through the Firm's Border Project. Dan was also part of a Jones Day team that successfully appealed an incarcerated pro bono client's case to the United States Supreme Court, which reversed the dismissal of the client's appeal at the circuit level under 28 U.S.C. § 2107(c).
