Power of removal by Board of Immigration Appeals is appealed

Client(s) Guevara, Eusebio

Jones Day client was found removable by an immigration judge, but granted relief from removal. On the Government's appeal, the BIA affirmed the removability finding, reversed the relief for removal, and ordered our client removed. The U.S. Court of Appeals for the Seventh Circuit affirmed. Jones Day sought certiorari from the U.S. Supreme Court, because the BIA does not have the power to order removal in the first instance.
