Atlas and GarMark bid for Schwab Industries assets

Client(s) Atlas Holdings LLC and GarMark Advisors LLC

Jones Day represented private equity funds Atlas Holdings LLC and GarMark Advisors LLC in their joint bid for the assets of Schwab Industries, a ready-mix concrete business with operations in Northeast Ohio and Southwest Florida. Atlas and GarMark were named stalking horse bidder and, while their bid was topped after an active auction process in May 2010, Jones Day successfully obtained payment of the break-up fee to Atlas and GarMark after a contested court hearing.
