NRSC, NRCC, JD Vance, and Steve Chabot secure Supreme Court decision striking down federal restrictions on coordinated campaign spending between political parties and candidates
Client(s) National Republican Senatorial Committee, National Republican Congressional Committee, and Vice President JD Vance
Jones Day represented the National Republican Senatorial Committee ("NRSC"), the National Republican Congressional Committee ("NRCC"), JD Vance, and Steve Chabot before the U.S. Supreme Court in their successful First Amendment challenge to federal restrictions on the amount that political parties can spend on campaign activities in coordination with their own candidates. Jones Day’s clients successfully argued that the restrictions violate the First Amendment and cannot be squared with recent Supreme Court precedent on campaign finance. As the Supreme Court observed, "[f]or nearly 200 years after the ratification of the First Amendment, parties could spend freely to support their candidates during campaigns and could do so in coordination with the candidates." Yet Congress more recently imposed severe restrictions on that conduct that "directly abridge the freedom of speech of the political parties." By removing these restrictions, the Court's decision ensures that "all political parties" will be able "to participate more freely and compete more fully in the political process, and to coordinate more closely with their candidates."
