Public Service Company of Colorado defends against complaint concerning rate of return on equity contained in certain wholesale power purchase agreements

Jones Day defended Public Service Company of Colorado ("PSCo"), a subsidiary of Xcel Energy Inc., in response to a complaint filed with the Federal Energy Regulatory Commission ("FERC") challenging the rate of return on equity contained in certain cost-based formula rate contracts for wholesale energy sales to certain large customers in Colorado. In its answer to the complaint, PSCo established that its existing ROE continues to be just and reasonable and that the arguments and evidence set out in the complaint are inadequate to justify a change in the current rates.
