PC Mall achieves settlement in related wage and hour class actions

Client(s) PC Mall, Inc.

Jones Day represented PC Mall, Inc. in a pair of related putative class actions brought against its subsidiary PC Mall Gov, Inc., and a division of PC Mall, known as MacMall. The first lawsuit was brought by Zekiya Whitmill and Lee Hanzy on behalf of certain of PC Mall Gov, Inc.'s outbound sales representatives. The second lawsuit was brought by Lee Hanzy on behalf of certain of MacMall's inbound sales representatives. The plaintiffs claimed that PC Mall Gov, Inc. and MacMall improperly classified them as exempt commissioned salespersons, failed to pay them overtime compensation, failed to provide meal and rest breaks, and engaged in unfair competition. Jones Day assisted in negotiating a settlement on mutually agreeable terms.
