CSXT obtains dismissal in whistleblower complaint filed under FRSA

Jones Day represented CSX Transportation, Inc. in a whistleblower complaint by an employee under the Federal Rail Safety Act. The company discharged an employee for providing false information and giving false statements related to the investigation of an alleged onsite injury, a decision later upheld by a Public Law Board. The employee filed an FRSA complaint claiming that he was terminated for reporting safety concerns. OSHA dismissed the complaint after determining that the protected activity was not a contributing factor in the decision to discharge the employee.
