Morton's negotiates settlement in FLSA wage and hour class action

Client(s) Morton's Restaurant Group, Inc.

Jones Day represented Morton's Restaurant Group, Inc. in a consolidated action involving 78 claimants. Employees alleged wage and hour claims under the FLSA and New York Labor Law on behalf of servers at Morton's New York locations, relating to the sharing of servers' tips with managers and distribution of a service charge for functions in private dining rooms. After taking over this matter from a different law firm, we negotiated a class settlement and obtained court approval of the settlement and individual releases.
